Court-Ordered and Mandated Therapy

Format: Individual or family therapy, depending on the referral and providerAges: Teenagers and adults, depending on provider and referral requirements

Court-ordered and mandated therapy is counseling that a person is required to attend as part of a legal, employment, school, child-welfare, probation, or other formal process. Mosaic may provide therapy for eligible mandated clients when the referral requirements fall within the therapist’s qualifications and scope of practice.

Being required to attend therapy can create frustration, anxiety, distrust, or uncertainty. Our goal is to explain the process clearly, treat you with respect, and help you identify what could make the time useful—even when beginning therapy was not your decision.

Who This Is For

Mosaic may be able to support clients who:

  • Need outpatient counseling and proof of attendance
  • Were referred by a court, probation program, employer, school, or child-welfare agency
  • Need help understanding what therapy will involve
  • Want to make required sessions personally useful
  • Are working on emotional regulation, relationships, substance use, trauma, coping, or reintegration
  • Have requirements that match an available clinician’s qualifications and scope

Acceptance must be confirmed before services begin.

About Court-Ordered and Mandated Therapy

What Is Court-Ordered and Mandated Therapy?

Mandated therapy can refer to several different services. Some orders require ordinary outpatient counseling and proof of attendance. Others request a specific evaluation, curriculum, report, treatment program, or professional credential.

Possible referral sources include:

  • A court, judge, attorney, probation officer, or parole officer
  • A child-welfare agency or family-service plan
  • An employer, licensing body, school, or academic program
  • A diversion, reentry, or community-supervision program
  • Another treatment provider or institution

Mosaic does not automatically accept every mandated referral. Before scheduling, we must determine what is being required, whether a Mosaic clinician is qualified to provide it, and what information must be shared with the referring party.

What Should I Confirm Before Scheduling?

Ask the referring party for written requirements whenever possible. Important questions include:

  • What exact service is required?
  • Is ordinary outpatient therapy acceptable?
  • Does the provider need a specific license, certification, or approved-vendor status?
  • Is there a required number or frequency of sessions?
  • Is there a completion deadline?
  • What documentation must be submitted and to whom?
  • Is proof of attendance sufficient, or is a formal evaluation or report required?
  • Are virtual sessions permitted?
  • Who is responsible for payment?

Bring the order, referral, service plan, or written instructions to Mosaic before the first appointment. Scheduling therapy does not guarantee that the service will satisfy a court or agency requirement.

Therapy Is Not Automatically a Forensic Evaluation

Treatment and forensic services have different purposes. A treating therapist focuses on your mental health and treatment goals. A forensic evaluator may be asked to answer a legal question, make a custody or fitness recommendation, evaluate risk for the court, or provide an expert opinion.

Unless explicitly agreed to in writing, Mosaic therapy does not include:

  • Custody evaluations or recommendations
  • Fitness-for-duty or parental-fitness evaluations
  • Psychological or neuropsychological testing
  • Independent forensic evaluations
  • Guaranteed letters, legal opinions, or court testimony
  • A promise that attendance will produce a particular legal outcome

If your order requires one of these services, Mosaic will help determine whether an appropriate clinician is available or whether you need a different provider.

Is Court-Ordered Therapy Confidential?

Therapy still includes privacy protections, but mandated services may require limited information to be shared. Depending on the order, authorization, and law, this could include attendance, participation, treatment recommendations, progress, completion, or safety concerns.

Before treatment begins, your therapist will explain:

  • Who the client is
  • What information may be shared
  • Who may receive it
  • What documentation Mosaic can and cannot provide
  • The limits of confidentiality, including safety and legally required reporting

You should have an opportunity to ask questions before signing a release of information. This page provides general information and is not legal advice; ask your attorney or referring authority how the requirement applies to your case.

Can Required Therapy Still Be Helpful?

Yes. You do not have to feel grateful for the mandate or agree with every part of the process for therapy to become useful.

Depending on your needs and referral, sessions may help you:

  • Understand patterns connected to the current situation
  • Strengthen emotional-regulation and coping skills
  • Address substance use, anger, trauma, relationships, or decision-making
  • Develop communication and problem-solving strategies
  • Prepare for reentry, employment, parenting, or other responsibilities
  • Identify personal goals beyond completing the requirement
  • Build options for moving forward

The therapist’s role is not to punish, shame, or force a predetermined personal conclusion. The work should remain honest about the mandate while treating you as a participant in your own care.

What to Expect

Before scheduling, Mosaic will review the referral requirements and identify whether an appropriate therapist is available. You may be asked to provide written documentation and contact information for the referral source.

The first session will include a discussion of what brought you to therapy, what is required, what information may be released, and what goals could make treatment useful to you. Your therapist will also review attendance expectations, documentation boundaries, payment, confidentiality, and the limits of their role.

Common Questions

Does Mosaic accept every court-ordered client?

No. Acceptance depends on the required service, provider qualifications, age, clinical needs, documentation requirements, safety, availability, insurance, and whether Mosaic’s outpatient setting is appropriate.

Will my therapist send reports to the court?

Only documentation agreed to in advance and permitted by the applicable authorization, order, law, and therapist role will be provided. Do not assume that detailed reports, legal opinions, or recommendations are included in routine therapy.

Will my therapist testify in court?

Routine therapy does not automatically include testimony or expert-witness services. Any subpoena, testimony request, or legal documentation will be handled according to applicable law, ethics, practice policy, and the therapist’s role.

What should I bring to my first appointment?

Bring the court order, referral, service plan, deadline, required-provider qualifications, documentation instructions, and contact information for the referring professional or agency.

Can mandated therapy be completed online?

Possibly. The referring authority must permit virtual care, the therapist must be authorized to practice where you are physically located, and telehealth must be clinically appropriate. Confirm these requirements before scheduling.

Does insurance cover court-ordered therapy?

Insurance may cover medically necessary treatment but may not cover evaluations, reports, classes, legal documentation, missed appointments, or services required primarily for legal purposes. Mosaic can help verify benefits, but the insurer decides coverage.
